Asylum Seekers and Social Security. The Reception of Asylum Seekers in Comparative and International Legal Perspective

When states were confronted with an increasing number of asylum applications, they reacted by implementing different measures to deter or prevent the arrival of asylum seekers. One of these measures was the exclusion of asylum seekers from general social security schemes and from the labour market. Some countries have excluded asylum seekers entirely from access to the labour market and from the right to social assistance. Other countries have turned from providing asylum seekers the same kind of social assistance as nationals to setting up schemes under which asylum seekers receive alternative and often very minimal forms of care. The purpose of this doctoral research is to analyse this use of social law as an instrument for migration policy and to examine how it relates to international human rights law. To that end, the position of asylum seekers in the social security system of different European and non- European countries will be compared. In particular, attention will be paid to the difference between the benefits for asylum seekers and the minimum subsistence level for nationals in the state concerned. The second part of the research examines which minimum norms with regard to the reception of asylum seekers arise from international and interregional law.
